Alana Mai Mitchell ReSIDEnTIALS
​​1. PRICES AND VALIDITY
To reserve a spot on a specified Residential, full payment is required, minimum 2 weeks in advance on your start date.

Exclusions: Airfares, passport and visa fees, travel insurance, excess baggage charges, airport taxes, medical expenses, optional activities, and any items of a personal nature are not included in your Residential price.

2. CANCELLATION & POSTPONEMENT BY ORGANISER
Alana Mai Mitchell reserves the right to cancel or postpone a Residence and will advise you no later than 28 days before the start date. If due to "Force Majeure" or government travel advice, she reserves the right to cancel or postpone at any time.

If postponed, Alana Mai Mitchell will offer alternative arrangements. If you cannot make the new dates, full payment will be refunded.

If cancelled and you do not accept alternative arrangements, Alana Mai Mitchell will refund all payments made to her (less any unrecoverable costs in the case of Force Majeure).

Force Majeure: Includes but is not limited to global pandemics, civil strife, terrorist activity, natural disasters, adverse weather conditions, and strikes. Alana Mai Mitchell is not liable for any delay or cancellation due to these circumstances.

3. CANCELLATION BY YOU
Notification of cancellation must be made to Alana Mai Mitchell in writing.

Cancellation Charges: Cancellations within 1 week of the start date forego 25% of the total cost.

Refunds: Cancellations up to 4 weeks before the start date are 50% refundable.

Mid-Residential: No refunds will be made if you leave a Residential for any reason after it has begun, or for any unused accommodation, transport, or services.

Insurance: We strongly advise consulting your travel insurance provider for cancellation refunds.

4. BOOKING AMENDMENTS

Transfers: You may request to transfer your booking to another month (if available) up to 30 days prior to your start date for a USD 50 fee (applicable per person). Only one transfer is permitted.

5. ASSUMPTION OF RISK
Alana Mai Mitchell operates the Residential and associated activities in regions of Brazil where standards of transport, safety, hygiene, and medical facilities may not match those you are used to at home. By booking, you acknowledge that participation involves inherent risks, including injury, death, psychological trauma, disease, or loss of property. It is your responsibility to accustom yourself with relevant travel advice from your government (e.g., US Dept of State, UK Foreign Office, Australian Department of Foreign Affairs and Trade (DFAT), or as applicable to your home country) before commencing the trip.

6. EXCLUSION OF LIABILITY & SUPPLIERS
Alana Mai Mitchell occasionally acts as an agent for local Brazilian service providers (guides, drivers, etc.). While she endeavors to appoint reputable suppliers, their terms and conditions apply and are incorporated into this contract.

Liability: Alana Mai Mitchell is not responsible for the acts or omissions of third-party providers. To the fullest extent permitted by law, you release Alana Mai Mitchell and her representatives from all claims arising from any damages, loss of enjoyment, or injuries.

Optional Extras: Any activity or service not expressly included in the itinerary is an "Optional Extra." Any assistance given by our team in booking these is purely at your request, and we disclaim all liability arising from participation therein.

7. AUTHORITY OF THE LEADER
At all times, the decision of Alana Mai Mitchell (or her representatives) will be final on all matters likely to affect the safety and well-being of the Residential. If you fail to comply with a decision or interfere with the well-being of people, the leader reserves the right to terminate your contract and order you to leave immediately with no right of refund.

8. TRAVEL INSURANCE, PASSPORT, & VISAS

Insurance: Adequate and valid travel insurance is compulsory for all travelers. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. Alana Mai Mitchell also recommends it covers cancellation, curtailment and loss of luggage and personal effects. You must carry proof of insurance with you and produce it if reasonably requested by Alana Mai Mitchell, her representatives or suppliers. Alana Mai Mitchell reserves the right to cancel or suspend your Residential or in certain activities, at any time, including after the commencement of your Residence, with no right of refund, if you are unable to provide proof of insurance when requested.

Passport: It is your sole responsibility to carry a valid passport (valid for 6 months beyond the trip).

Visa: It is your sole responsibility to obtain the appropriate Brazilian visas.

9. HEALTH, FITNESS, AND AGE LIMITS
You must disclose any pre-existing medical conditions or disabilities at the time of deposit. Participation is restricted to those aged 18 and over.

10. Content
Alana Mai Mitchell will request your permission to use images/video/audio taken of you during the Residence without recourse or compensation to you, for the purpose of accurately communicating the Residence experience reality to people, through whatever medium chosen.

11. PRIVACY & DATA
To provide our services, Alana Mai Mitchell must collect personal and health information. This data may be shared with local service providers only to enable the services provided and will be handled with strict confidentiality.
​
12. REFUSAL OF SERVICE
Alana Mai Mitchell retains the right to refuse service to any person at any time, for any lawful reason whatsoever, in her sole discretion.

13. COMPLAINTS
Complaints must be made immediately to the organiser on-site, which all attempts will be made to resolve within a reasonable timeframe. If a resolution is not possible, you must notify us in writing of your complaint within 30 days of the end of the Residential.

14. SEVERABILITY & GOVERNING LAW
If any term is found to be unenforceable, it shall be severed or amended only to the extent necessary to allow the remaining terms to survive. This agreement is governed by the laws of New South Wales (NSW), Australia, and both parties submit to the exclusive jurisdiction of the courts of NSW.

15. UPDATING OF TERMS & CONDITIONS
Alana Mai Mitchell reserves the right to update or alter these terms and conditions at any time. It is the Client’s responsibility to be familiar with the latest version, always available on www.alanamaimitchell.com and will supersede any previous versions.
